By accessing, viewing, or using the products, services, information, or other materials available on or through carepilot.com, you, the User, indicate that you understand these Terms of Use and that you accept such Terms of Use and agree to comply with them. CarePilot reserves the right to change these Terms of Use from time to time. CarePilot will post the most recent date of review on this page. Your continued use of carepilot.com following any such change(s) to these Terms of Use will be conclusively deemed acceptance of such change(s).

2. Privacy Policy

The use, storage, and disclosure of confidential information contained in carepilot.com may be subject to various federal and state laws, including, but not limited to, laws addressing privacy rights and confidentiality of medical records. In addition, state laws dealing with HIV status, mental health, genetic testing information and substance abuse may also govern the use, storage and disclosure of confidential information contained in carepilot.com. 3. Termination

CarePilot reserves the right, in its sole discretion, to immediately suspend or terminate these Terms of Use and/or your ability to use carepilot.com and/or any other service provided to you by CarePilot, without cause and without notice to you.

In the event that CarePilot determines, in its sole discretion, that you have breached any portion of these Terms of Use, or have otherwise demonstrated conduct inappropriate for carepilot.com, CarePilot reserves the right to (a) warn you via email that you have violated these Terms of Use; (b) delete any content provided to CarePilot; (c) discontinue your ability to use carepilot.com and/or any other service provided to you by CarePilot; (d) notify, send content to, and/or fully cooperate with the proper law enforcement authorities for further action; and/or (e) any other action which CarePilot deems to be appropriate.

4. Modifications to carepilot.com

5. CarePilot & Public Areas

If you use a Public Area, such as a chat room, bulletin board or community forum, you are solely responsible for your own communications, the consequences of posting those communications, and your reliance on any communications found in the Public Areas. CarePilot and its licensors are not responsible for the consequences of any communications in the Public Areas. In cases where you feel threatened or believe someone else is in danger, you should contact your local law enforcement agency immediately. If you think you may have a medical emergency, call your doctor or 911 immediately.

You understand and agree that you are responsible for the content of any messages posted or sent by you or any user of your account (whether authorized or unauthorized), and the consequences of any such messages. By submitting communications or content to the Public Areas, you agree that such submission is non-confidential for all purposes.

In consideration of being allowed to use the Public Areas, you agree that the following actions shall constitute a material breach of these Terms and Conditions:

1. Using a Public Area for any purpose in violation of local, state, national, or international laws;
2. Posting material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others;
3. Posting material that is illegal, libelous, harmful, vulgar, profane, sexually oriented, threatening, racially offensive, inaccurate, obscene, defamatory, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity as determined by CarePilot in its sole discretion;

5. After receiving a warning, continuing to disrupt the normal flow of dialogue, or posting comments that are not related to the topic being discussed (unless it is clear the discussion is free-form);
6. Posting chain letters or pyramid schemes;
7. Impersonating another person;
8. Distributing viruses or other harmful computer code;
9. Harvesting or otherwise collecting information about others, including email addresses, without their identification for posting or viewing comments; consent;
10. Allowing any other person or entity to use your identification for posting or viewing comments
11. Posting the same note more than once or "spamming"; or
12. Engaging in any other conduct that restricts or inhibits any other person from using or enjoying the Public Area or the Site, or which, in the judgment of CarePilot, exposes CarePilot or any of its customers or suppliers to any liability or detriment of any type.

CarePilot reserves the right (but is not obligated) to do any or all of the following:

1. Record the dialogue in public chat rooms.
2. Investigate an allegation that a communication(s) do(es) not conform to the terms of this section and determine in its sole discretion to remove or request the removal of the communication(s).
3. Remove communications which are abusive, illegal, or disruptive, or that otherwise fail to conform to these Terms and Conditions.
4. Terminate a user's access to any or all Public Areas and/or the CarePilot Site upon any breach of these Terms and Conditions.
5. Monitor, edit, or disclose any communication in the Public Areas.
6. Edit or delete any communication(s) posted on the CarePilot Site, regardless of whether such communication(s) violate these standards.

CarePilot or its licensors have no liability or responsibility to users of the CarePilot Site or any other person or entity for performance or nonperformance of the aforementioned activities

You understand and acknowledge that: (a) CarePilot permits you access to content that is protected by copyrights, trademarks and/or other intellectual property and proprietary rights ("Rights"); (b) the Rights are valid and protected in all media and technologies existing now or later developed; and (c) except as otherwise set forth, these Terms of Use and the applicable copyright, trademark, and other laws govern your use of such content. If you are trying to sign on to our site and you have forgotten your password, CarePilot will send you an email with a special link back to the site where you can reset your password. For security and privacy reasons, if you forget both your original password and the answer to your reminder question, your account will be permanently locked until you recall one or the other.
